Terms for Reserving and Holding a Promoter Night — CLUB CODE

1. Parties and Electronic Conclusion
1.1. These Terms govern the relationship between KUULSAUND OOD, UIC 205613968, Plovdiv, 47 Porto Lagos Str. (the "Club") and the person requesting a promoter night through the form on clubcode.bg (the "Promoter") — a business or an individual, per the data in the request.
1.2. By ticking the "I accept the Terms" box and submitting the form, the Promoter makes an electronic statement within the meaning of the Bulgarian Electronic Document and Electronic Trust Services Act (ZEDEUU). The parties agree, pursuant to Art. 13(4) ZEDEUU, that ticking the box has the force of a handwritten signature in the relations between them.
1.3. For each acceptance the Club stores: the version and full text of the accepted Terms, date and time, IP address, device/browser and the Promoter's verified account (email and phone). The accepted Terms are permanently available at clubcode.bg/promoter-terms/, and the version accepted by the Promoter is stated in the reservation confirmation.
2. Two-Phase Booking
2.1. Phase 1 — Date reservation: the request locks the date upon the Club's approval. The lineup may be announced later.
2.2. Phase 2 — Finalization: no later than 30 days before the event the Promoter submits the final name, lineup, door price and service order through the "Finalize the night" form. Services are ordered and priced at the current price list at the moment of finalization, shown in the form. Any calculation shown at reservation time is indicative, based on the price list in force at that moment, and is not binding on the parties.
2.3. Finalization is submitted once, only when the program is fully ready. Subsequent changes are agreed with the Club before public announcement.
2.4. A lineup not confirmed in time / an unfinalized night entitles the Club to release the date, after an invitation and an additional 7-day period.
3. Services, Revenue and Payments
3.1. Security, door control, hosting (Door Girl), cleaning and copyright fees are provided by the Club at the Promoter's expense, per the price list in the form (min. 2 security staff per night).
3.2. The design of all visuals for the Club's channels (posters, pages, tickets) is produced only by the Club's team for a fee per the price list. The Promoter may use the Design Kit for their own channels.
3.3. Revenue from entry ticket sales belongs to the Promoter; bar revenue remains with the Club. When tickets are sold through the clubcode.bg platform, proceeds are accounted for and paid out to the Promoter at settlement after the event. If promo conditions are announced for the date (fixed fee or percentage of the door), they are shown in the form at reservation and are frozen for that request.
3.4. Services are settled after the event, except the advertising budget (Facebook Ads), which is due in advance.
3.5. The Club may require a deposit from promoters without an established history; the conditions are communicated before approval of the reservation.
4. Holding the Event
4.1. The Promoter agrees in advance with the Club: lineup and support, start and end times, sponsor logos, branding and all advertising materials.
4.2. Not admitted: persons under 18, persons in an intoxicated/aggressive state, bringing in food/drinks/dangerous items by visitors.
4.3. The Promoter and persons engaged by them use the Club's equipment with due care and comply with sound level instructions.
4.4. The event starts and ends at the announced times; setup is completed 1 hour before the start and technical checks 30 minutes before the start.
4.5. The Club may remove a person of the Promoter from the premises for intoxication, incompetence or behavior endangering safety or reputation, without owing compensation.
5. Liability
5.1. The organization and performer engagements are at the Promoter's expense. The Club owes no remuneration to the Promoter's subcontractors.
5.2. The Club is not liable for power interruptions by the grid operator, but provides a backup generator where possible.
5.3. Each party is liable for damages culpably caused by it or by persons engaged by it.
6. Withdrawal and Cancellation
6.1. The services relate to leisure activities on a fixed date — the right of withdrawal under Art. 50 of the Consumer Protection Act does not apply, pursuant to Art. 57(12) CPA.
6.2. Cancellation by the Promoter less than 21 days before the date entitles the Club to retain the deposit (if paid) and release the date.
6.3. In case of force majeure the parties notify each other immediately and agree on a new date.
7. Personal Data, Language and Governing Law
7.1. Personal data is processed in accordance with the clubcode.bg Privacy Policy (GDPR).
7.2. These Terms are drawn up in Bulgarian; the English translation is for information. In case of discrepancy, the Bulgarian text prevails.
7.3. Bulgarian law applies. Disputes are referred to the competent court in Plovdiv.
